Customer Protection in Microfinance: Regulatory Compliance Monitoring Tool

Project Introduction

This study examines the impact of the Reserve Bank of India’s April 2022 microfinance regulatory framework on the sector, assessing the level of compliance by Microfinance Institutions (MFIs) with customer protection guidelines. It evaluates how borrower-household repayment capacity assessments are implemented, the extent to which key loan-related facts are disclosed to borrowers prior to sanctioning, and how closely MFIs, their staff, and agents adhere to prescribed standards of conduct in loan recovery practices across India’s diverse microfinance market.

Project Methodology

The study employed a combination of in-person and telephonic surveys with hundreds of microfinance customers across MFIs, covering repayment capacity assessment, information disclosure and transparency, borrower repayment experience and indebtedness, recovery-practice experience, and MFI conduct. Surveys were distributed across all four regions of India — North (Uttarakhand, Uttar Pradesh), South (Karnataka, Tamil Nadu), East (Odisha, West Bengal), and West (Maharashtra, Rajasthan) — using a balanced mix of telephonic and in-person interviews, and covered three customer categories: rejected applicants, regular re-payers, and delinquent borrowers. DIA led enumerator training on both the survey instruments and the regulatory framework, along with translation, transcription, and data quality monitoring.

Impact

The data collection resulted in the publication of a research report titled “Emerging Trends and Shifts in Microfinance,” which revealed widespread awareness and acceptance of the new regulations. Given the diversity on both sides of the market — lenders and customers — approaches to regulatory requirements vary greatly: while most mandates are followed in letter, some are lost in administrative translation, resulting in gaps between formal compliance and practical implementation.
